Life is full of unexpected events. Whether you are planning or are unexpectedly faced with having to make difficult decisions regarding your personal affairs or on a loved one's behalf, we will travel to area hospitals to assist in notarizing documents.
Requesting a notary for hospital notary work, a valid identification is needed. If you or the patient is unable to provide valid identification, the State of Florida allows the sworn written statement of two credible witnesses whose identities are proven to the notary and who are personally known to the signer.
An affidavit is a common form of sworn statement that requires one to take an oath or affirmation in front of a Notary Public or any public official who has the authority to administer oaths. A deposition is the signed testimony of a witness taken outside of court in which lawyers ask oral questions of the witness. To begin the deposition the deponent will be sworn to tell the truth and then asked a series of questions by lawyers. Upon completion the deponent will then sign the deposition before an official witness. It is up the affiant or deponent to determine whether they wish to take an oath or an affirmation when asked to complete an affidavit or deposition. It is worth noting that notaries public are not legal professionals and it is outside of our authority to suggest whether you wish to take an oath or affirmation.
Florida, notaries are authorized to attest to the trueness of photocopies of certain documents.
A notary public may make attested photocopies if the following criteria, found in section 117.05(12) of the Florida Statutes, are satisfied.
The document must be an original document.
A notary public cannot make an attested photocopy from a photocopy, or from another certified copy. The document cannot be a public record, certified copies of which are available from another public official. If a certified copy can be obtained from the official source, then the notary public can decline the request.
The making of the photocopy must be supervised by the notary public. It is not sufficient for the notary public to compare the photocopy with the original document. The notary public must actually make the photocopy or supervise another person while he or she makes the photocopy.
The following documents can be photocopied from the original (if not officially filed or recorded) and attested to by a notary, because certified copies cannot be obtained from another public official:
An Apostille service certifies that a document is acceptable for use in another country. This procedure entails obtaining the necessary paperwork and having it approved by a Secretary of State’s office, then stamping the document with an official seal. Many documents must be authenticated or certified before they can be accepted and used for official purposes in other countries. The apostille authenticates the signature and commission of the signing authority and ship them to the Secretary of State Department to have your documents apostilled.

The couple must obtain a marriage license from a county court judge or clerk of the circuit court in Florida and present it to the notary public before the marriage ceremony. A marriage license is valid for 60 days after issuance.
There is a 3-day waiting period after issuance of the license before you can get married, unless you have completed the Florida pre-marital course, in which case the waiting period is waived.
For non-Florida residents a marriage license is effective immediately upon issuance.
In order for a prenup to be valid in Florida, it must meet certain legal requirements. First, full and frank financial disclosure is required to enter into a valid prenup. It must be in writing and signed by both parties in the presence of a notary. The agreement must also be witnessed by two adults who are not related to either party.
The prenuptial agreement must be fair and reasonable, and each party must have the opportunity to seek independent legal counsel before signing. Finally, the agreement cannot conflict with public policy or law.
Prenuptial agreements written in Florida must not include anything that violates public policy or law. Two things that should not be included in a prenup agreement are conditions set for child custody or child support. In the event of a divorce, the courts in Florida will determine these based on what would be in the best interest for the child or children.
For lenders, the certified notary signing agent serves as the final link to complete a home loan. They are hired by the lender as independent contractors with the task of making sure the proper execution of real estate loan documents is completed by the borrower.
Loan paperwork can be confusing, so having notary signing agents as part of the process is a real benefit. They understand important concepts like your state’s notary laws, any applicable federal law that should be taken into account, and many other details regarding your mortgage documents and the loan process.
Florida law provides that a financial institution may open a safe-deposit box if the rental fee is past due, providing that proper notice has been made and that certain other conditions are met.
A notary public is authorized and required to be present for the opening of the safe-deposit box, to inventory the contents of the vault, and to make an appropriate certificate of the opening.
The notary is not required to estimate the value of the contents of the safe-deposit box.
